Terms of Service
Welcome to Affili Markets. These Terms of Service ("Terms") govern your use of the Affili Markets platform, websites, applications, and related services operated by Affili Community Development, LLC ("Affili Markets," "we," "our," or "us").
By accessing or using Affili Markets, you agree to these Terms.
1. About Affili Markets
Affili Markets is a platform designed to help organizations, venues, vendors, and market managers manage markets, events, vendor applications, booth assignments, communication, scheduling, social media publishing, administrative workflows, and related operational activities.
Affili Markets may include integrations with third-party services such as Meta/Facebook, Instagram, Stripe, email providers, mapping providers, analytics services, and AI-assisted tools.
2. Eligibility
You must be at least 18 years old to use Affili Markets.
By using the platform, you represent that you have authority to enter into these Terms, all information you provide is accurate, and you will comply with applicable laws and regulations.
3. User Accounts
To access certain features, you may need to create an account.
You are responsible for maintaining the confidentiality of your account, safeguarding login credentials, and all activities occurring under your account.
You agree to notify us immediately of unauthorized use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraud, abuse the platform, interfere with other users, or violate applicable laws.
4. Vendor and Organization Responsibility
Organizations, venues, and vendors are solely responsible for the accuracy of listings and applications, permits and licensing, taxes, insurance, product legality, event compliance, fulfillment of sales or obligations, and communications sent through the platform.
Affili Markets is not a party to transactions between vendors, venues, or customers unless explicitly stated.
5. Payments and Third-Party Services
Affili Markets may integrate with third-party payment processors such as Stripe.
Payment processing is subject to the terms and policies of those providers.
Affili Markets does not store full payment card information on its servers.
We are not responsible for payment processor outages, banking failures, chargebacks, or third-party service interruptions.
6. Social Media Integrations
Affili Markets may allow users to connect social media accounts such as Facebook Pages and Instagram Business Accounts.
These integrations are optional.
By connecting a social account, you authorize Affili Markets to publish approved content, retrieve basic account or Page information, and maintain the connection using access tokens provided by Meta.
Affili Markets stores only the minimum connection information required to maintain social integrations, such as access tokens, selected Page information, linked Instagram Business account identifiers, and publishing capability status.
Users may disconnect social integrations at any time through platform settings.
Disconnecting a social integration removes stored Meta connection data and access tokens associated with that connection.
Affili Markets does not claim ownership of user social media content.
Use of Meta services is additionally governed by Meta's and Instagram's terms and policies.
7. AI Features
Affili Markets may provide AI-assisted features including content suggestions, social media generation, workflow assistance, document analysis, summaries, recommendations, and automated insights.
AI-generated outputs may contain inaccuracies.
Users are responsible for reviewing and approving AI-generated content before use.
Affili Markets does not guarantee the accuracy, completeness, suitability, or legal compliance of AI-generated outputs.
8. Acceptable Use
You agree not to violate laws or regulations, upload malicious software, attempt unauthorized access, interfere with system operation, scrape or harvest data, impersonate others, upload unlawful or infringing content, or use the platform for spam or abusive activity.
We reserve the right to investigate and remove content or suspend accounts violating these Terms.
9. User Content
Users retain ownership of content they upload or create on Affili Markets.
By submitting content, you grant Affili Markets a non-exclusive license to host, process, display, transmit, backup, and use the content solely for operating and improving the platform.
You represent that you have rights to any content you upload.
10. Privacy
Use of Affili Markets is also governed by our Privacy Policy.
Affili Markets processes user information in accordance with applicable privacy laws and platform functionality.
11. Data Deletion and Account Removal
Users may disconnect social integrations, remove stored Meta connection data, request deletion of their account, or delete their account through platform tools where available.
Deleting an account may permanently remove organization data, vendor information, applications, uploaded files, messages, and associated operational records.
Some records may be retained where required by law, fraud prevention, dispute resolution, or legitimate business purposes.
12. Availability
We strive to maintain reliable service but do not guarantee uninterrupted availability.
Affili Markets may modify features, perform maintenance, suspend services, discontinue features, or update integrations at any time.
Third-party API providers may also affect functionality.
13. Intellectual Property
Affili Markets, including its software, branding, designs, logos, and platform functionality, is owned by Affili Community Development, LLC and protected by intellectual property laws.
Users may not copy, redistribute, reverse engineer, resell, or create derivative works from the platform without written permission.
14. Disclaimer of Warranties
Affili Markets is provided "AS IS" and "AS AVAILABLE."
To the maximum extent permitted by law, we disclaim warranties including merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, and accuracy of outputs or data.
15. Limitation of Liability
To the maximum extent permitted by law, Affili Markets and Affili Community Development, LLC shall not be liable for indirect damages, lost profits, data loss, business interruption, consequential damages, third-party actions, social platform restrictions, API access loss, or AI-generated inaccuracies.
Our total liability shall not exceed the amount paid by the user to Affili Markets during the twelve (12) months preceding the claim.
16. Indemnification
You agree to indemnify and hold harmless Affili Markets and Affili Community Development, LLC from claims arising from your use of the platform, uploaded content, violations of these Terms, legal violations, vendor operations, or organizational operations.
17. Governing Law
These Terms shall be governed by the laws of the State of Georgia, United States, without regard to conflict of law principles.
Any disputes shall be resolved in courts located in Georgia.
18. Changes to Terms
We may update these Terms periodically.
Continued use of Affili Markets after changes become effective constitutes acceptance of the revised Terms.
